1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the website operated by Genusify at www.genusify.com (the "Site") and any content, features, or services offered on or through the Site (together with the Site, the "Services").
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Description of services
Genusify provides digital agency services including, without limitation, system design, software development, scalability consulting, WebRTC and real-time communication expertise, AI-related solutions, and related professional services. The Site provides information about our capabilities, portfolio content, blog articles, and ways to contact us.
Specific engagements for paid work are governed by separate statements of work, master services agreements, or other written contracts executed between you and Genusify. Where those agreements conflict with these Terms regarding a particular project, the project-specific agreement controls for that project.
3. Eligibility and acceptable use
You agree not to:
- Use the Services in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Services, other users' accounts, or Genusify's systems or networks;
- Introduce malware, scrape or harvest data in an abusive manner, or interfere with the proper functioning of the Site;
- Use the Services to transmit spam, fraudulent, defamatory, or unlawful content;
- Reverse engineer, decompile, or disassemble any part of the Services except where such restriction is prohibited by law;
- Use automated means to access the Services in a way that imposes an unreasonable load on our infrastructure.
We may suspend or terminate access if we reasonably believe you have violated these rules or pose a risk to the Services or others.
4. Intellectual property
The Site and its contents—including text, graphics, logos, layouts, images, video, software, and compilation of content—are owned by Genusify or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent, except as allowed by applicable law.
Feedback you provide about our Services may be used by us without obligation to you, except where prohibited by law.
5. Third-party links and services
The Site may contain links to third-party websites or services. We are not responsible for third-party content, practices, or policies. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
6. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Case studies, blog posts, and performance figures on the Site are illustrative and not guarantees of future results for your project.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GENUSIFY OR ITS DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNTS YOU PAID GENUSIFY FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, IF ANY.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Genusify and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
9. Governing law and disputes
These Terms are governed by the laws applicable in the jurisdiction where Genusify primarily operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country require otherwise.
Any dispute arising from these Terms or the Services shall be resolved in the courts located in that jurisdiction, unless applicable law requires a different venue. You consent to the personal jurisdiction of those courts.
10. Changes to these terms
We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Services after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Services.
11. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Genusify regarding the Services and supersede prior agreements on that subject.
